The Failure of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency triggered by the presentation of a new 28-point plan for achieving ceasefire appeared – momentarily – to have been contained. A American diplomat spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, Moscow made its response: another massive barrage of rocket attacks on Kyiv.

The Rhythm of Peace Talks and Military Action

The succession of conflicting incidents captured the harsh reality of the current period. By day, political struggles are conducted: optimistic declarations are delivered from multiple capitals. Immense energy is allocated on containing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the main instrument for achieving "peace".

Nocturnal Warfare

As military strikes progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is capable of detecting projectile deployments from enemy soil, a capacity enabled by current data. From observation points, Ukrainian air force fighter jets that had been deployed to counter approaching cruise missiles flew past – advanced fighter aircraft delivered to Ukraine by European allies.

Moments later, Kyiv's anti-aircraft weapons activated: defensive missiles fired to intercept a hostile projectile. This was a sophisticated defense system at work, most likely provided by partner states. Every deployment creates sudden vibrations, shaking the windows. The moment of terror quickly gives way to resigned acknowledgment: maybe the hostile projectile won't strike its target this time, sparing the city from ruin and further power outages.

Continuous Dangers

Soon after, a large-caliber weapon engaged a aerial vehicle close by, part of a mobile-fire group – almost certainly Western-made equipment. Regrettably, the shots failed to hit the hostile drone – it pressed on overhead toward its objective.

With pauses, this carried on until dawn. Kyiv greeted the morning news: several casualties, destruction and utility failures in numerous residences as a result of the night's assault. As customarily, everyone still continued their routines – enduring hostilities. But those entire period illustrated Ukraine's vital need on external assistance – a dependence that neighboring countries are evidently unprepared to replace in the near term.

Ineffective Peace Efforts

The comprehensive proposal from American leadership provoked deep reactions, debate and profound anxiety – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have seen this script before, after prior negotiation attempts and international summits.

Every new proposal from American administration follows the identical sequence: a political offensive against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually secure success. This pattern will, no doubt, persist.

Tactical Assessments

It is convenient to criticize certain parties of repeatedly advocating Russian terms. But that does not seem to be the whole story. Washington functions according to a assumption well known to seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The US administration assumes that it is unrealistic to compel Moscow to relinquish the territory that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while acknowledging this situation, American administration does little to deter Moscow, through diplomacy or military means, from assuming that the situation will not change more in its favour in the months ahead.

Opposing Positions

Therefore, the Kremlin is convinced that time is on his side – that Ukraine and its allies are approaching exhaustion. Their motivation to agree to terms that does not give them the maximum possible gain is virtually nonexistent. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's leader remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, progressively conceding people and territory but preventing a complete military breakdown until situations evolve in its benefit.

Current Realities

Factually, there are no real preconditions for a ceasefire. Now, subjective factors are entering the equation: leadership ambitions to broker a ceasefire and secure international recognition, and Kyiv's twin challenges – on one hand, not to distance important partners, and on the other, to mobilize citizens around the flag against any initiative Kyiv finds unworkable, so that their priority does not move to domestic problems. And although their task will now be considerably more difficult after current events, it remains very improbable that this will change their overall approach.

These two forces are influencing discussions.

Summary and Prospects

It took a just a single week to terminate the proposed articles of the most recent proposal. Aggressive and erratic handling of the matter by Washington, resistance by Ukraine and the rest of Europe, along with calming attempts of representatives, and finally, current information leaks, all did their job.

While new plans based on old ideas are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and demonstrate specific hesitation to alter the situation, if they maintain solidarity and improve their protective measures at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the predictable period, mainly require sustained allied backing.
